1. Rules and Regulations
1.1 Adherence to the program
1.1.a. To become a member of the Program, member shall submit the Adherence Form in some of the Argentina Mining events or accept the Regulations and General Conditions of Use of the Program via email, which was sent to the interested party by Argentina Mining in due course, and the interested party shall register in the Program. Once registration is completed, Argentina Mining shall understand that the member expressly accepts the Regulations included herein and agrees to participate in the Program.
1.1. b. Members shall provide certain data to access the services offered by the Program. It is compulsory that all the data provided shall be true and valid. Argentina Mining shall not store sensitive data. Information is processed and stored in servers or magnetic media property of Argentina Mining. All information shall remain confidential in accordance with Argentina Mining’s privacy policy for internal information systems and pursuant to national Act number 25.326 (protection of personal data).
1.2 Privacy
1.2. a. Argentina Mining shall not publicly expose third parties different from Argentina Mining, except the holder gives their express consent.
1.2. b. Member understands that Argentina Mining may send communications, alert messages, state of accounts, and/or other communications via email and/or other media in order to comply with the nature of the service, and member gives their full consent to make this possible.
1.2. c. Member promises not to use the information sent by Argentina Mining for any other purpose other than the use specified in this program. Member shall not create any database of any kind for later commercialization or advertising, SPAM, or sending E-magazines or other communications of any kind whatsoever.
1.2.d Adherence to the program entails the member’s express authorization so that Argentina Mining is entitled to broadcast or publish their name and/or image and/or voices and/or photographs (at Argentina Mining Membership events) for advertising or commercial purposes, through the media and in the ways Argentina Mining shall determine, without the right to compensation, for a period of five (5) years as from the date of adherence to the Program, being an essential requirement for the issuing of the benefits that Argentina Mining Membership is allowed to display the corresponding advertising.
1.3 Reasons for termination
1.3. a. Death of the holder. The account shall expire automatically in case of death of the holder.
1.3. b. Waiver to the program. Member may terminate their participation in the Program at any time by notifying it in writing to Argentina Mining S.A. (Agustín Álvarez 1348, Bº Arizu, Godoy Cruz, M5501BFB, Mendoza, Argentina) or to the following email address – membership@argentinamining.com.
1.4 Inappropriate use of the membership
1.4. a. Argentina Mining may close an account or invalidate the accumulated points in the event the Member attempts to damage the Website http://argentinamining.com and/or the Account and/or alters in any way the operation specified in the Program. In said circumstances, Argentina Mining may also, at their sole discretion, prevent the person from subsequent participation in the program, and undertake the legal measures which are deemed appropriate.
1.5 Terms and conditions of membership use
1.5. a. Use of the membership is restricted to the terms and conditions herein stated. Once the member has received the membership card certifying that he/she is a member of Argentina Mining Membership, he/she shall present it in order to validate access to the benefits. Members who shall not have their membership card shall present their member personal number or a copy of the invoice either in paper or digital format.
1.5. b. Individual membership is PERSONAL and NON-TRANSFERABLE. The failure to comply with this condition authorizes Argentina Mining to cancel the Account and, possibly, undertake the legal measures which are deemed appropriate.
Individual and corporate memberships are not refundable.
Membership is valid per calendar year only, regardless of the moment of payment/renewal. Only the members who have their memberships in force, at the moment of using it, shall have access to the benefits.
1.6 Amendments of the General Conditions of Use
1.6. a. Argentina Mining may amend these Rules and Regulations at any time publicly notifying said amendments in the Web Page http://argentinamining.com. All amendments shall be considered valid as of fifteen (15) days after its publication. After said maturity date has become due, it shall be understood that member accepts the new terms and conditions and these Regulations and/or subsequent amendments shall continue to relate both parties.
1.6. b. In case Member disagrees with the amendments introduced in the Regulations by Argentina Mining, member shall communicate their disagreement and request the cancellation of their membership in writing within the deadline specified in the previous paragraph. Argentina Mining shall immediately close the Member’s Account.
1.7 Legislation
1.7. a. These General Conditions of Use shall be governed by, construed and enforced in accordance with the laws of the Republic of Argentina, to all that has not been expressly amended in these General Conditions of Use, in accordance with the free will of the parties.
